1. Agreement to Terms

Welcome to Real Legend Homes Ltd. These Terms of Service ("Terms") govern your access to and use of our website, mobile services, WhatsApp channels, social media pages, and all related real estate brokerage, property management, and construction services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you and Real Legend Homes Ltd, a company registered in Nigeria with RC Number 8938013.

2. Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts under Nigerian law to use our Services. By using our Services, you represent and warrant that you meet these requirements. If you are using our Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Our Services

Real Legend Homes Ltd provides the following services to clients across Lagos, Ogun, Abuja, and other locations in Nigeria:

• Property Brokerage: Facilitating the sale, purchase, and rental of residential, commercial, and industrial properties.
• Property Development: Developing and marketing new residential and commercial projects.
• Facility Management: Managing properties on behalf of owners including tenant sourcing, rent collection, and maintenance.
• Construction Services: Connecting clients with verified contractors and supplying building materials.
• Property Consultation: Providing market analysis, valuation, and investment advisory services.
• Shortlet Management: Managing furnished short-term rental apartments and vacation homes.

4. Property Listings and Information

We strive to ensure that all property listings, descriptions, images, and pricing information on our website and marketing materials are accurate and up to date. However, property information may change without notice, and we do not guarantee the accuracy, completeness, or timeliness of any listing.

Property prices, availability, and specifications are subject to change at any time. We strongly encourage all clients to verify property details through a physical inspection and independent legal verification before entering into any transaction. Real Legend Homes Ltd is not liable for any discrepancies between listed information and actual property conditions.

5. Client Obligations

When using our Services, you agree to:

• Provide accurate, current, and complete information in all inquiries and forms.
• Use our Services only for lawful purposes and in compliance with all applicable Nigerian laws.
• Not engage in fraud, misrepresentation, or deceptive practices in any property transaction.
• Not attempt to circumvent our brokerage services by dealing directly with property owners or other agents introduced through us without our knowledge and consent.
• Respect the confidentiality of property information and not share listing details with unauthorized third parties.

6. Fees and Commissions

Our fees and commissions vary depending on the service provided and are disclosed to clients before engagement. Standard practices in the Nigerian real estate market include:

• Sales: Agency commission, typically a percentage of the property sale price, payable by the seller upon successful completion.
• Rentals: Agency fee (typically 10% of annual rent) and legal fee (typically 10% of annual rent), payable by the tenant.
• Shortlets: Service fees included in the nightly or monthly rate, disclosed at booking.
• Facility Management: Monthly management fee, typically a percentage of collected rent, as agreed in the management contract.

All fees are payable as agreed in writing. Failure to pay agreed fees may result in suspension of services and legal action for recovery.

7. Property Viewings and Inspections

We arrange property viewings at mutually convenient times. Clients must provide reasonable notice for cancellations or rescheduling. Repeated no-shows without notice may result in refusal of future viewing arrangements.

Clients are responsible for their own safety during property inspections. We are not liable for any injury, loss, or damage occurring during viewings unless caused by our gross negligence.

8. Deposits and Payments

Booking deposits for property reservations are typically non-refundable unless the property becomes unavailable through no fault of the client. All deposits are held in trust and applied toward the final transaction amount.

For off-plan and under-construction properties, payment schedules follow the developer's terms. We strongly recommend clients engage independent legal counsel before signing purchase agreements or making substantial payments.

9. Title Verification and Due Diligence

While we conduct initial due diligence on all listed properties, we strongly encourage clients to conduct independent title verification and legal checks. We can recommend trusted legal partners for this purpose. Real Legend Homes Ltd is not a law firm and does not provide legal advice. We are not liable for title defects, encumbrances, or disputes that arise after a transaction.

10. Intellectual Property

All content on our website including text, images, logos, videos, and design elements is the property of Real Legend Homes Ltd or our licensors and is protected by Nigerian and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

Property photographs and descriptions are provided for client reference only and may not be used for competing commercial purposes without authorization.

11. Limitation of Liability

To the maximum extent permitted by Nigerian law, Real Legend Homes Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, including but not limited to lost profits, lost data, or business interruption.

Our total liability for any claim arising from our Services shall not exceed the total amount of fees you have paid to us in the 12 months preceding the event giving rise to the claim, or ₦100,000 (One Hundred Thousand Naira), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Real Legend Homes Ltd, our directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your violation of these Terms, your use of our Services, or your negligence or misconduct.

13. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason including violation of these Terms, fraudulent activity, or behavior that harms our business or other clients. Upon termination, all provisions that by their nature should survive termination shall remain in effect.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through mediation or arbitration in Lagos State, Nigeria, in accordance with the Arbitration and Conciliation Act.

15. Changes to These Terms

We may modify these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of our Services after changes constitutes acceptance of the revised Terms.
